You're in the middle of trial.
You sued your doctor for medical malpractice.
For causing you harm and injury.

Your doctor denies all your claims.
Before trial, the defense refused to offer you a dime.
They wanted to take a verdict.

Your attorney had no choice but to try your case because the defense hadn't offered a dime.
But during the trial, something changed.
Something happened to get the defense to change their mind.

They realized your case was much stronger than they thought.
They recognized the jury is responsive to our witnesses and our experts.
They calculate in their own mind what will likely happen.

The defense comes to the conclusion they need to limit their risk.
The risk of the jury coming back with a huge verdict against them.
How can they minimize or reduce the risk of that happening?

Simple.
Offer to settle the case.
Offer less money than what you're worried will happen if the jury decides against you.

We also have a risk.
A risk of going to verdict.
A risk we could lose the case.

A risk we could win but get much less than we think your case is worth.
A risk that if we get a large verdict, it will be appealed and you won't have a definitive answer for another 1-2 years.

Ok, so we start negotiating.
We actually reach an agreement.
You're thrilled.

We tell the judge during the middle of your trial, we are settling your case.
The judge turns to us and says "Not a chance! You're trying this case to verdict! Now get back to work."
CAN THE JUDGE DO THAT?
